If you are injured in an accident, you are entitled to compensation. Some compensation items are self-explanatory and come with receipts. Other compensation items are more difficult to monetize. Consider the fact that others now have to take over your household chores. If you don’t officially hire those, but they come to help you, how do you estimate those damages? What about chores around the house you can no longer do? What about extra miles you have to drive?

To reduce the amount of discussion about these claims, the Personal Injury Council has developed guidelines. We use these a lot in our files because they are clear and often fair. They also limit unnecessary discussion.

Who is the Personal Injury Council?

The Letselschade Raad is an umbrella organization that includes the ANWB, the Association of Insurers, Slachtofferhulp Nederland and Letselschade-experts. They looked again in December 2022 to see if the amounts in the 2022 guidelines were to be indexed. The method of the Working Group on Standardization is used here.

Examples of guidelines

There are several guidelines that were re-indexed this year. For example, the allowance for domestic help went up, the allowance for travel expenses increased by 33%, and the annual amount for damages due to study delay went up. Below we briefly outline some of the guidelines that have changed. There is also a guideline for damages, but we do not use it. This is because punitive damages are something that, by definition, must be considered on a case-by-case basis. It is something very personal.

Directive Domestic Assistance

The Domestic Assistance Directive that determines the contributions that apply when you hire domestic help, third party or friends and family – who help you in the household after the injury occurred. The standard amount that applied in 2022 changed to €11 per hour as of January 1, 2023. Note that this is therefore about extra help from family and friends who are not hired. For that group, whether the agreed rate is reasonable is of course fully taken into account.

Mileage reimbursement guidelines

The Mileage Reimbursement Directive 2023 was also increased due to the car cost increase. The allowance for traveling by car was changed to €0.33 per kilometer driven.
